 PICO Modern Agriculture Company application and services for users – terms and conditions

Judicial scope

Important notice: Please read these application terms and conditions (“Terms”) before accessing or using the PICO application and services.

These terms and conditions for the PICO application and services for users are set out as provided by the PICO Modern Agriculture Company. Your access to or use of the PICO application and services for users in the Arab Republic of Egypt is subject to these terms, including but not limited to those specific to the preservation, transfer, sharing, confidentiality, intellectual property, dealings with other parties and compensation. If you do not agree to these terms or wish to discontinue using the PICO User Application, you must not continue to use the application or access or use its services. Your continued access to the application and use of the services means your agree to abide by these terms.

These terms relate to the use of the application and PICO services available on the PICO application as detailed below.

1-Definitions

“Application” is the PICO mobile phone application that allows customers to purchase PICO products and deliver them to their homes. The application provides smooth and smart marketing services for all household needs available by PICO and electronic sales services to the public, by downloading an application on the user’s mobile phone.

The company means PICO Modern Agriculture Company.

 

This electronic platform enables the company (PICO Modern Agriculture Company) to display its products and services.

“The user” or “you” means any natural person in Egypt, whether Egyptian or foreign, who is not less than 18 years old, who downloads the application on his mobile phone, completes the process of registering his data, entering his name, email, mobile phone number,  all the required data, and receives a text message. Via his mobile phone confirming the process of  properly registering it in the application and explicitly agrees to these terms.

You agree to update and amend the above registration data, if necessary, from time to time in accordance with PICO’s policy.

“Products” are any products sold by PICO to the customer in accordance with the laws and regulations applicable in the Arab Republic of Egypt through the application and other products available to the company.

Quick Damage products: Products referred to in Articles Nos. 13 and 26 of the Executive Regulations of the Consumer Protection Law issued by Resolution No. 882 of 2019, in which it is not permissible to request a withdrawal from the contract regarding them without reasons. If your order has any problems related to quality, please notify us during receipt or no later than the same day of delivery.

All goods whose characteristics or method of packing and packaging preclude their replacement, refund or cannot be returned to  normal conditions upon contract.

 “Electronic invoice”: It means the electronic invoice issued by PICO through the application to the customer and includes the date, customer name, type, price, number of products sold and their price, and includes the tax registration number and the commercial registry of PICO.

 

Privacy policy

This Privacy Policy describes our policies and procedures relating to the collection, use and disclosure of your information when you use the Service and informs you of your privacy rights and how the law protects you.

We use your personal data to provide and improve the Service. By using the Service, you consent to the collection and use of information in accordance with this Privacy Policy.

Interpretation and definitions

Explanation

The words of which the first letter is capitalized have meanings defined under the following conditions. The following definitions must have the same meaning regardless of whether they appear in the singular or plural.

 

Definitions

For the purposes of this Privacy Policy:

Account means a unique account created for you to access our Service or parts of our Service.

The Company (referred to as “the Company”, “we” or “us”

PICO Modern Agriculture Company, abbreviated to PICO, and its address is 3 Shagaret El Dorr St. – Zamalek – Cairo – Egypt.

The country to: Egypt

Device means any device that can access the Service such as a computer, cell phone or digital tablet.

Personal data is any information relating to an identified or identifiable individual.

 

2-Terms of agreement

These terms represent a binding legal agreement between you and the PICO Modern Agriculture Company S.A.E., an Egyptian joint stock company established in accordance with the provisions of Egyptian laws and whose head office is 3 Shagaret El Dor St., Zamalek – Cairo, commercial registration 218757 (hereinafter referred to as “PICO”); By downloading, uploading or using the application for the purposes of opening an account,  accessing or using the services, you: –

1) You agree that you have read, understood, accepted and agreed to these terms

2) You acknowledge that your express consent to these terms will automatically apply once you have used the application and services

3) You acknowledge and agree that PICO has the right to terminate access to your account immediately if you violate(breach) any of these terms.

4) You expressly acknowledge and agree that you are solely responsible for the accuracy of your data,  account and the password that you entered with your knowledge to access your own account through the application, and you alone have the right to use the account personally, and no one other than you may use the account. In case of violation of any of the above, you expressly acknowledge and agree that PICO has the absolute right to terminate access to your account and to terminate these Terms in such event.

5) You expressly agree that PICO may obtain some or all of your personal data available on the application and agree to PICO’s sharing of that data with any of its employees or third parties to provide the services subject to these terms, taking into account the provisions of the applicable personal data protection law.

6) You expressly acknowledge and agree that PICO is not responsible for any advertising content for products, services, etc. Available on the application and that the advertising party is responsible for obtaining the necessary licenses and approvals to make this advertising content available for its products or services without any responsibility on PICO.

 

 

 

  1. Usage of PICO application and services

You must create an active and valid account on the application in order to use PICO services by following the steps as detailed below:-

  • You download the application on your mobile phone, explicitly agree to these terms and enter the following data:
  • To log into your account on the app and purchase products, enter your email address, mobile phone number, address, and any other required information as specified by the app. You will then receive a text message on your mobile phone containing a verification code. Once you receive the code, enter it into the app. After correctly entering the verification code, you will be able to log into the app and purchase products.

View products

The products appearing on the site will be displayed as accurately as possible, but your perception of the colors will depend on your screen, and we cannot guarantee that your screen’s display of the product colors will be accurate.

Ordering products:-

  • You must create an effective and valid account on the application in order to purchase products as detailed below: – You search on the application through the search feature for the products that you wish to purchase that are available on the application, and you place the products displayed on the application in the purchase cart, and By entering the delivery address, reviewing the order, choosing the appropriate payment method, and confirming that, you will receive confirmation that your order has been submitted successfully.
  • You hereby expressly acknowledge and agree that the products purchased and displayed on the application are sold directly to you by PICO when available.
  • You expressly agree that the quantity of products available on the application may be updated from time to time according to their availability.
  • You hereby expressly acknowledge and agree that the exchange and return policy for products, whether regular products or quickly perishable products offered through the application, will be subject to the provisions of Consumer Protection Law No. 182 of 2018 and its executive regulations and any amendments that may occur to them.

4 -Amendment and termination

PICO has the right to terminate these terms and services by providing you with prior notice on the application or by e-mail for a period of 72 hours before the termination takes effect

 

without your consent. Your agreement to the terms and continued access to the services is considered prior approval to grant PICO this right at its own discretion.

PICO has the right to amend these terms without your consent, and your agreement to the terms and continued access to the services is considered a prior consent to grant PICO this right at its sole discretion, without prejudice to PICO ’s right to terminate the terms in accordance with clause (a). PICO has the right to terminate these terms immediately or any Services provided in connection with you, or (b) generally stop providing the Services or block access to them or any part thereof at any time in the event of your breach of these Terms.

5-Closing the account due to non-use

Your account on the application will remain valid for a period of 12 months from the date of your last use of the application. If you do not use the account for 12 consecutive months, the account may be closed automatically.

6- Customer identity, fraud detection, personal data protection laws, and electronic crimes

You hereby expressly acknowledge and agree that in order to provide you with security, to prevent fraud or personal identity theft, and to comply with personal data protection and cybercrime laws and regulations (as applicable), PICO will request information from you when you open your Application account in order to confirm your identity in order to allow you to open an account on the App, maintaining it, and using the Services. We may also ask you to update and verify your information from time to time, as this is one way in which PICO can ensure that you are the only person who can access your account via the application.

PICO may delay your access to the Application and Services until you comply with this information request or other verification steps that PICO may request at any time.

7-PICO’s services:

PICO reserves the right to amend the scope of the Services in order to add or modify other services and to amend its terms. The application may be used in Egypt only.

8 -Payment policy 

You expressly agree to pay for the products or services you requested through the application directly in cash or by bank or credit card at the POS machine upon receipt or in advance by bank or credit card, as the case may be, and in accordance with the payment terms of any of them.

You agree to add your bank card data on the application (if available) for electronic payment options through the application through PICO’s partners who are licensed payment service providers.

Do not share any of the user’s password for creating the account or the user’s card data with anyone, as this information will not be requested from the PICO team, nor will the changed password if the service is available on the customer’s card.

 

9 -Cancellation, exchange and return policy

You agree to the following order cancellation terms:

  1. You have the right to cancel the order through the application as long as the order has not been sent without paying any fees.
  2. If the order is sent and not received, you will pay cancellation fees determined based on the delivery price for the place of the order
  3. In all cases, without prejudice to the provisions of Consumer Protection Law No. 182 of 2018 and its executive regulations and any amendments that apply to them.
  4. You have the right to inspect the products at the time of delivery and retrieve any of them with the delivery representative, provided that this is deducted from your shopping cart and payment is made for the products received only by you.
  5. You have the right to return or exchange products if your order has any quality problems. Please notify us during receipt or no later than the same day of delivery.
  6. If you purchase perishable products, you are not entitled to return or exchange them except in accordance with the provisions of Consumer Protection Law No. 182 of 2018 and its executive regulations and any amendments that apply to them.
  7. The value of returned orders that were previously paid using bank cards will be refunded within 10 working days or according to the usual period depending on the bank implementing the refund process.

 

Credit/debit card details

We reserve the right to refuse to accept or cancel a credit/debit card if the transaction has been accepted in our sole discretion as part of our fraud detection program.

The credit card / direct debit card data provided by you to benefit from the website’s services must be correct, valid and accurate, and you must use the credit card or direct debit card that is legally owned by you. For example, in transactions conducted by credit card / direct debit card, you must use the credit card / Your direct debit card

The aforementioned data will not be used or exchanged by us with other parties unless it is necessary to verify the presence of fraud or pursuant to a law, regulation or judicial order.

  • We will not be responsible for any fraud committed using a credit card/debit card
  • The responsibility for using a card in a fraudulent manner will fall on you, and the responsibility to prove otherwise will fall exclusively on us.

In the event of returning products, PICO is committed to refunding the price of the products through the following methods:

  • In the event of a return, the customer is obligated to keep the product in the same condition in which it was received in accordance with the Consumer Protection Law
  • In the event of payment via prepaid bank cards or credit cards, the amount will be recovered through the payment service providers contracted with PICO within the usual period for payment in this case by the banks.
  • In the event of payment by cash upon receipt, the amount will be returned via a credit balance to the customer in the amount of the amount in the application. He has the right to purchase any product displayed in the application from the date the returned products are received and inspected by PICO .

 9 – Unauthorized use of your account and fraudulent activities 

You agree to notify PICO immediately upon becoming aware of any activity involving fraud or theft of your account on the application.

Notifications may be directed to PICO via the application or e-mail (the company’s email is posted. You are solely responsible for notifying PICO of any fraud related to your account.

You agree that PICO is not responsible for unauthorized use of your account on the Application. PICO reserves the right (in its sole discretion) to suspend or cancel any use of the Application where PICO suspects that its Application has been obtained or used fraudulently, illicitly or illegally, involves criminal activity, or otherwise in the event of your violation. For these conditions.

10-Ownership:

You hereby acknowledge that PICO is the sole owner of the Application and/or related services.

11-Applicable law and dispute resolution:

These terms and conditions are subject to Egyptian law.

The parties agreed that any dispute arising from or related to these terms will be referred and finally settled by the competent Egyptian courts.

Service to application.

Service Provider means any natural or legal person who processes data on behalf of the Company. It refers to third party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit)

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

Usage data

Usage Data is collected automatically when you use the Service.

Usage Data may include information such as your device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the service via or through a mobile device, we may automatically collect certain information, including but not limited to, the type of mobile device you use, your mobile device’s unique identifier, your mobile device’s IP address, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers, and other diagnostic data.

We may also collect information that your browser sends when you visit our Service or when you access the Service by or through a mobile device.

While using our app, in order to provide our app features, we collect, with your prior permission:

We use this information to provide features of our Service, to improve and customize our Service. The information may be uploaded to the Company’s and/or service provider’s servers or may simply be stored on your device.

You can enable or disable access to this information at any time, through your device settings.

Use of your personal data

The Company may use personal data for the following purposes:

To provide and maintain our Service, including monitoring the use of our Service.

To manage your account: To manage your registration as a user of the Service. The personal data you provide can give you access to various functions of the Service available to you as a registered user.

To execute the contract: Develop, comply with and undertake the purchase contract for the products, items or services you have purchased or any other contract with us through the Service.

To contact you: To contact you by email, phone calls, SMS or other similar forms of electronic communications, such as push notifications of mobile applications regarding updates or informational communications regarding functionalities, products or contracted services, including security updates, when necessary or reasonable to implement.

To provide you with news, special offers and general information about other goods, services and events we offer that are similar to those you have already purchased or inquired about unless you have opted not to receive such information.

To manage your orders: To attend and manage your requests to us.

For business transfers: We may use your information to evaluate or effect a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a stand-alone entity or as part of bankruptcy, liquidation, or similar proceeding, in which the personal data we hold is Information about users of our service is among the transferred assets.

The Company will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain usage data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, unless we use this data to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

You have the right to request our assistance in deleting the personal data we have collected about you.
